BEND, Ore. (KTVZ)-Η αστυνομία στο Μπεντ και όλο το Όρεγκον, ενδέχεται να μην εμπίπτουν στην εντολή εμβολιασμού για τον κρατικό πάροχο υγειονομικής περίθαλψης.
«Αυτή τη στιγμή, δεν υπάρχουν υποχρεωτικά εμβόλια από την αστυνομία στο Μπεντ», δήλωσε την Τετάρτη η Άν Αουράντ, διευθύντρια επικοινωνίας της πόλης Μπεντ.
Είπε ότι η πόλη ακολουθεί τις οδηγίες της Αρχής Υγείας του Όρεγκον.
"Ο OHA έχει διαπιστώσει ότι οι αστυνομικοί πιθανότατα δεν υπόκεινται στον υποχρεωτικό κανόνα εμβολιασμού και η πόλη ακολουθεί τις οδηγίες του OHA", δήλωσε ο Aurand. "Η πόλη δεν έχει λάβει απόφαση αυτή τη στιγμή να απαιτήσει από οποιονδήποτε από τους υπαλλήλους της να εμβολιαστεί, εκτός από αυτούς που υπόκεινται στους κανόνες του OHA", δήλωσε ο Aurand.
Ο OHA την περασμένη Παρασκευή δημοσίευσε 11 σελίδες απαντήσεων σε συχνές ερωτήσεις σχετικά με την εντολή εμβολιασμού για τον κυβερνήτη σε όλη την επικράτεια της υγειονομικής περίθαλψης.
Για το ερώτημα αν καλύπτεται η αστυνομία, λέει
"Μάλλον όχι. Ενώ ένας αστυνομικός μπορεί να έχει κάποια ιατρική εκπαίδευση ή ακόμη και να είναι αδειούχος πάροχος υγειονομικής περίθαλψης, πιθανότατα δεν αποτελεί θεμελιώδες μέρος της δουλειάς του να παρέχει άμεση ή έμμεση ιατρική περίθαλψη σε περιβάλλον υγειονομικής περίθαλψης. Εάν ένας αστυνομικός έχει μια δουλειά που εξ ορισμού απαιτεί να παρέχουν ιατρική φροντίδα σε άτομα, τότε ο κανόνας πιθανότατα ισχύει ».
Το Q&A καλύπτει επίσης οδοντιάτρους, EMS και πυροσβέστες, οι οποίοι υπόκεινται στον κανόνα και μια σειρά διαδικαστικών ερωτήσεων.
Ο υπολοχαγός Jayson Janes με το γραφείο του σερίφη της κομητείας Deschutes είπε ότι υπάρχουν αρκετοί υπάλληλοι και δικηγόροι που εργάζονται σε όλη την πολιτεία για να λάβουν τις τελικές αποφάσεις.
Είπε, μέχρι τότε, το γραφείο του σερίφη δεν επιβάλλει εντολή.
Εννέα στρατιώτες της αστυνομίας του Όρεγκον, πέντε από το Κεντρικό Όρεγκον και μια ομάδα κρατικών πυροσβεστών κατέθεσαν πρόσφατα μήνυση εναντίον του κυβερνήτη, αμφισβητώντας τη νομιμότητα της εντολής του εμβολίου και την προθεσμία της 18ης Οκτωβρίου για να πάρουν τους πυροβολισμούς ή να αντιμετωπίσουν πιθανή απόλυση.
Δεν είναι σαφές πότε και αν θα ληφθεί απόφαση σε επίπεδο πολιτείας, αν και η αγωγή θα μπορούσε να παίξει ρόλο.

Let’s say there are two patients who present to an ER in COVID ravaged Idaho. One has been vaccinated and one not. Both need medical care. Since then Chief Krantz has ensured a proper response as the pandemic grew.

Is anyone familiar with an Oregon law from 1989, SB 741? It appears that the healthcare workers COVID vaccine mandate is illegal in Oregon?

Outside, probably an astute observation on your part. If so, it reveals the legal talents the state will put to use when it needs to. Rescinding laws and regulations after they’ve been forwarded to a higher court is often effective in getting cases dismissed entirely without an adverse ruling. It’s the way the game is played.
